I am using the pseudonym “Jill” as the party involved..
I will start out by providing the conversations between
myself and the crook…
Everything is a copy and paste of the
exact words used, except for the crooks real name.
The buyer (“jill”) created a return (5056090219)
Reason for return
- Doesn't match description or photos
Comments
- Picture and description say game is mint but back of the box is crushed.
Shipping box was undamaged. Need this for a gift for a collector so game must be
mint and now will not get it in time, need to return.
You sent a message -
The game was mint and you know it. The game came straight from the master case
as pictured in the auction. It was never touched until I took it out of the case
to ship. If it is crushed now, it happened because you crushed it to get your
money back. You tried to cancel the auction and I wouldn't do it. Next time, try
reading the title and the description before bidding or buying. I'm not a
store....
The buyer sent you a message -
You lied about the condition of the item, clearly did not want to make a picture
of the back that showed the damage. Not even close to mint.
You sent a message -
You do know what you're doing is fraud? Mail fraud if I'm not mistaken. I will
pursue your actions legally with the USPS postal service.
The buyer sent you a message - The game was damaged
before you mailed it, I have the original box; this is not the USPS' fault. I am
very disturbed by your accusations and your business practices, selling damaged
goods is fraud.
You sent a message -
I wasn't the only one to see what was shipped to you. I also made my own
documentation before packing this game because I knew I was going to have a
problem with you when you wanted to cancel the auction. Before you dig your hole
any deeper, maybe you should check out my documentation. The link I am sending
you is is from my own server.. It shows a picture of both the front and back of
the game I sent you along with the picture properties of the back picture. I
will provide these pictures to ebay as well...
http://www.atwoodcs.com/atwoodtm/jill/jill.html
The buyer sent you a message -
That could easily be another game, you have several behind the damage one you
sent to us in the auction pics. This appears more like CYA because you knew you
were committing fraud by send us the damaged copy. We use Ebay properly and our
feedback proves it, we do not play games. Please escalate this to Ebay if you
are not going to do the right thing here.
You sent a message -
Apparently you have no idea who I am and my honesty and integrity in the game
collecting community. Maybe you should do your research before you start to
defraud someone. Maybe I should contact Pat the Nes Punk so he can make another
podcast about me, this time you would be included, of course.... Using ebay
properly doesn't include fraud.
The buyer sent you a message -
Go ahead, we have nothing to hide. Sop threatening me and just escalate this; if
you think you are right then Ebay will cover you.
You sent a message -
I don't make threats. The game I shipped was perfectly mint. The only reason it
is damaged now is because you were informed you would loose the return.. So you
smash the box so you can return the game, not as described. I'm certain the
people at ebay will see right through your scheme after they read all our
messages on 5/19..
The buyer sent you a message -
We did not damage the game and our feedback speaks for itself. First you are
going to report me to the USPS, then Pat the NES punk; stop wasting my time and
just escalate the case.
You sent a message -
Open a claim then.
The buyer sent you a message -
As the buyer we have to wait until 5/25, as the seller you can escalate is
sooner.
I called eBay as soon as I received the message. I was waiting for this message.. It took a transfer to get back to the right ebay department. The lady I talked to about this situation, didn’t pay any attention to what I was telling her. She didn’t have time to do any of her own investigation. She closed the claim in the crooks favor while we were talking.
Reimbursement information:
Transaction #: 0
Date of transaction: May 19, 2017
Amount refunded to buyer: $111.47
Date of refund: May 30, 2017
Reason for refund: Item did not match your item description
Amount reimbursed to eBay: $111.47
Date of reimbursement: May 30, 2017
After receiving this message I called ebay to start the appeal. Whomever I was talking to, we talked for quite some time. There was one comment in particular towards the end of our conversation that didn’t set well. She told me they can’t claim the buyer damaged the game, in which I replied. I know what was shipped and I saw the pictures the buyer provided. The shipping box was not damaged or opened when the buyer took the picture to use it for the claim.
May 31,
2017 I went to the, leave feedback page and reported this crook for abusing the
buyers protection program.
Comments: The game I shipped this buyer was mint, it came straight out of a case that I opened myself. This was a second chance offer for the buyer. After they won and paid, I printed the shipping label then they wanted to cancel the auction. I wouldn't cancel the auction for the reason they used. The title and description states exactly what the buyer will receive, 1 game. The buyer told me that when they get the game they will request a return. I informed the buyer eBay has already sided with me for the same example. The buyer received the game and destroyed it so they could get their money back for, not as described. Their actions were pre planned, as you can tell if you look at their picture of he shipping box, it hadn't even been opened yet!!!!!! They knew what they were going to do before opening that box!!!! They used this picture to show the box hadn't been damaged during shipping. Why would they take a picture of the unopened undamaged box before opening it? They knew what the were going to do!!!! I took pictures of this game before packing and my wife was watching as it was packed. I figured I was going to have a problem with this buyer. I saved all our conversation for the cancel and for the return as , not as described. I also saved their pictures and I have mine. Excuse my language but this is bullshit when a buyer is able to commit at least 2 frauds, postal and wire and eBay helps them get away with it!!!!!
We'll take your confidential report and review it with other internal information (including reports from other sellers). Although we know you've submitted this report, it is anonymous to your buyer. Also, please note that we won't be able to tell you of any specific action taken for confidentiality reasons.
Sellers like you help keep the eBay marketplace a safe
place to buy and sell. – What a pile of
shit!!! Apparently ebay is only made safer it others take their own actions!!!
I filed my complaint with the FBI June 6, 2017, 6:49:33 PM
As you will notice I added ebay in this complaint. As far as I’m concerned they are complicit in this fraud…
I am providing a .PDF for the FBI report. My complete
statement wasn’t captured in this .PDF so I am providing what was reported. I
also have it saved in .html

FBI STATEMENT.
On 5/18/2017 I had an auction end on ebay, http://www.ebay.com/itm/262980747583
The same evening I sent” jill” a second chance offer for the game. “Jill” came in second place on the bidding.
http://www.ebay.com/itm/262992618953
The following morning 5/19/2017 “jill” purchased the game, they sent payment and I printed the shipping label. I get back on my computer and I noticed a message from the ebay, the buyer wants the auction cancelled. I get a message from the buyer, thru ebay asking if I will cancel the aution. I informed the buyer I don't cancel auctions any longer, especially for the reason they stated. I was told they thought it was for the whole case, the title and description states exactly what they will receive 1 game. We have a go around thru ebay messages. During our conversation, “ jill” told me that when they get the game they will request a return. I informed” jill” that ebay has sided with me before for the exact same circumstances. It's not my fault the buyer was to lazy to read the description for what they will receive. (When buying or selling on ebay you are agreeing to a binding contract). After our conversation I figured I would have a problem with this person so I took pictures of the game I was sending. I packaged that game and shipped it out on 5/19/2017, “jill received the game 5/22/2017.

The same day I get a message from ebay, the buyer submitted a return request for the game, reason - not as described. The buyer states the game arrived damaged. This buyer can't even stick to a story, first they want the auction cancelled because they thought they were getting the case and not 1 game, then they get the game and they say they needed a mint game to give to a collector.
The buyer provided pictures to ebay for this fraudulent case. They provided the shipping box, it was undamaged and it wasn't even opened yet. How would the buyer know what the game would look like before even opening the package and use the picture for a, "not as described" case unless they already knew what was going to happen? The buyer also provided pictures of the smashed game. I provided my pictures of the game that was shipped. My wife watched me as I was packing this game. She knows what I shipped out was a perfectly mint game.
I called ebay and talked to, I believe her name was Keisha, We talked for quite awhile. She read all our messages and looked at the pictures. I was told they would side with me, reason; buyers remorse. She told me she was adding comments to this request but she couldn't do anything because it wasn't a claim yet.
The buyer and I had another go around thru ebay for this return. I am providing a link with all the pictures and our conversations.
http://www.atwoodcs.com/atwoodtm/jill/jill1.html
On 5/26/2017 the buyer escalated this request into a case, Case # 5137760624. I called ebay as soon as I received the message about this case. I'm not sure who I ended up talking to. I told this lady about my conversation with Keisha. She would have nothing to do with what I was telling her. She ended the case as we talked and sided with the buyer. She didn't even have time to read our messages or anything.
On 5/30/2017, ebay stole my money and gave it back to the crook. Ebay also charged my account $4.30 so the buyer could send back the game they smashed. As far as I'm concerned, ebay is complicit in this fraud. I filed an appeal with ebay on this date as well. The person I talked to this time actually listened to me. She told me she can't say if the person smashed the game and I replied. I know what was shipped and I saw the pictures the buyer provided. The shipping box was not damaged or opened when the buyer took the picture to use it for the claim.
How can a mint game get smashed when there is no damaged to the box? I doubt someone from the USPS opened the box, smashed the game put it back in the box and resealed it. Nope.....
I hadn’t received a message from ebay in regards to my telephone appeal yet so,
6/7/2017 2:09:20 PM I started an appeal online.
6/7/2017 2:11 PM there were 2 emails that were sent to my regular email account.
I would think that was very quick even
for ebay standards?
Hi atwoodtm,

eBay Customer Support has reviewed the case and made a final decision.

Details:
Comments:
We're sorry there was a problem this transaction. However, after further review,
we confirmed that our original decision was correct.
The second one stated,
Dear Timothy,
Thank you for contacting eBay Customer Service in regard to the SUPER PINBALL BEHIND THE MASK SNES NINTENDO GAME, item# 262992618953 you sold. My name is Marilyn and I am a specialist from eBay's Resolution Center. I want to provide you with an update to your appeal for this dispute.
I understand you disagree with our decision to let the buyer return the item because you had sent the buyer exactly what was described in the auction. I can see that this has been a frustrating experience, especially after you will be receiving your sold item back and having to issue a refund. Let’s work through this together.
When your buyer opened a claim of ‘Doesn’t match description or photos‘, we had to have the item returned to you, so you could inspect the validity of your buyer’s complaint. I trust that you sent the item in good condition but I hope you can understand that eBay doesn't see or handle items, so it's difficult for us to determine the exact condition of the item when it was sent or received. As a seller you are responsible for getting the item to the buyer without any issues, or for making things right if problems arise.
Furthermore, if you think that your buyer may have been abusing eBay’s Money Back Guarantee, please make sure to report the buyer, and we will be taking appropriate action towards their account. I know that this is not the answer you are expecting from us, but please remember, situations like these are a cost of doing business on any ecommerce selling platform.
I noticed that you have been an eBay member since 2001. That is quite an achievement! We certainly appreciate your continued business with us and we hope that it will continue for many more years ahead.
We certainly appreciate your understanding in this difficult situation and we thank you in advance for choosing eBay as your business partner.
I trust this information has been useful and I wish you the best of luck trading on eBay in the future.
Sincerely,
Marilyn N.

Of course I had to
reply to that . ;-)
Sent: 6/7/2017 4:55:07 PM -- I know what I shipped this crook and I also know what she did to this game, just so she could get her money back. She did not return the game in the same condition it was sent to her!

Please do not hesitate to reach out to me if you have any questions or concerns.

My last reply and I doubt I will get a return, I haven’t yet…
And what documentation was that? A picture of a shipping box that was not damaged or even opened at the time. Some pictures of the game they smashed. The stating of more than 1 story. First they didn't want the game and wanted to cancel the auction, then all of a sudden they wanted the game for a collector.
I provided pictures of the game that was shipped.
Apparently some people that work at eBay are so stupid to actually believe I would ship a game to anyone in that condition and put myself through all this bullshit. Like I said earlier I filed with the FBI for principle, because this isn't just mail fraud it is also wire fraud.....
Talk about ethics?
